These Terms and Conditions ("Terms") govern your access to and use of our background screening services. By accessing or using our services, you agree to comply with these Terms. If you do not agree, you must refrain from using our services.

1. Definitions

  1. "CheckProvide" refers to the background screening services provided under this brand, owned and operated by GuardPass.
  2. "Client" refers to businesses or individuals engaging CheckProvide for screening and vetting purposes.
  3. "User" refers to any individual or entity accessing our services, including employers, hiring managers, and other authorized representatives.
  4. "Candidate" refers to an individual being screened as part of the services provided.
  5. "Report" refers to the background screening results provided to clients.
  6. "Third-Party Provider" refers to external sources from which data is obtained or payment processors facilitating transactions.
  7. "Confidential Information" refers to all non-public business, technical, financial, or personal information disclosed by either party in relation to the services.

2. Scope of Services

  1. CheckProvide provides comprehensive background checks and screening services in accordance with BS7858 standards, including but not limited to:
    • Identity Verification
    • National Insurance Validation
    • Anti-Money Laundering (AML) Checks
    • Right to Work Verification
    • 5-Year Address History Verification
    • 5-Year Career Verification
    • 5-Year Education Verification
    • Financial Records Screening
    • County Court Judgment (CCJ) Checks
    • Global Watchlist Screening
    • Optional DBS Checks
  2. Our reports contain factual information based on data obtained from third-party providers. We do not provide recommendations, endorsements, or opinions on hiring decisions.
  3. Clients are solely responsible for interpreting and making hiring decisions based on the reports provided.
  4. CheckProvide does not guarantee the completeness or accuracy of reports due to reliance on third-party data.

3. Client Obligations

  1. Clients must ensure that all candidates have provided explicit and informed consent for their background check before submission.
  2. Clients must provide accurate and complete candidate details. CheckProvide is not responsible for errors due to incorrect information submitted by clients.
  3. Clients shall not misuse the information provided in the reports for unlawful, discriminatory, or unethical hiring practices.
  4. Clients are responsible for ensuring compliance with all applicable employment, privacy, and data protection laws when using our services.
  5. Clients must maintain the confidentiality of reports and ensure they are not disclosed to unauthorized parties.
  6. Clients agree to indemnify and hold CheckProvide harmless from any claims or legal consequences arising from the misuse or misinterpretation of screening reports.

4. Intellectual Property

  1. All content, software, and materials related to CheckProvide, including but not limited to trademarks, logos, proprietary software, and reports, are the property of GuardPass or its licensors.
  2. Clients may not copy, reproduce, distribute, modify, or create derivative works from any content associated with CheckProvide without prior written permission.

5. Payment, Refunds, and Fees

  1. Payments: All payments must be made through our designated third-party payment processors (e.g., Stripe, PayPal). Check Provide is not responsible for any errors, disputes, or security breaches arising from third-party payment processing.
  2. Refunds: Refunds are only available until ID verification has been completed. Once ID verification is processed, no refunds will be issued under any circumstances.
  3. Fee Changes: CheckProvide reserves the right to modify pricing at any time. Any pricing changes will be communicated before implementation.

6. Data Privacy, Retention, and Security

  1. CheckProvide complies with the UK GDPR, Data Protection Act 2018, and other relevant regulations.
  2. Candidate screening data will be automatically deleted 60 days after the final report is sent to the client unless legally required to retain it for longer.
  3. Clients cannot request deletion of reports before the mandatory retention period expires.
  4. We implement strict security measures, including encryption and restricted access, but cannot guarantee absolute security.

7. Dispute Resolution and Liability

  1. No Disputes on Reports: Clients cannot dispute the results of a completed screening report.
  2. Liability Disclaimer:
    • CheckProvide is not responsible for hiring decisions made based on screening reports.
    • We do not guarantee the accuracy of third-party data.
    • We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
  3. Dispute Resolution: Any disputes shall first be resolved through good-faith arbitration before litigation.

8. Indemnity

  1. Clients agree to indemnify, defend, and hold harmless Check Provide, its parent company GuardPass, affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:
    • The misuse or misinterpretation of screening reports.
    • Violation of these Terms.
    • Any unlawful or negligent act by the client in relation to the services provided.

9. Force Majeure

  1. CheckProvide shall not be held liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to:
    • Natural disasters
    • Government regulations or restrictions
    • Cybersecurity attacks or breaches
    • Technical failures
    • Acts of war or terrorism

10. Termination

  1. We reserve the right to suspend or terminate services if a client violates these Terms.

11. Governing Law

  1. These Terms are governed by the laws of England and Wales.
